Terms of Service

DriveTrace lets you record car drives using device GPS, store drive history and garage vehicles, connect with friends, receive optional push notifications, and view distance-based leaderboards (friends, country, and global). We may also offer optional DriveTrace Premium (or similarly named) paid features via auto-renewable in-app subscriptions. Features may change, and we may add, modify, or discontinue functionality with reasonable notice when practicable.

Optional in-app navigation uses Apple MapKit (or similar platform APIs) for live map and routing while you record your actual driven path. We do not provide a custom turn-by-turn navigation engine and are not responsible for routing decisions you make while driving.

Some features of the App may remain available without a paid subscription. Premium content or features require an active subscription as described in the App and at the time of purchase.

• You must be at least 13 years old (or the age of digital consent in your country) and legally able to agree to these Terms.
• You must sign in with a supported authentication provider (e.g. Google, and Apple when available) and keep your account secure.
• You are responsible for activity under your account. Usernames must not impersonate others or violate law or these Terms.
• One person should not create accounts to manipulate leaderboards or evade bans.
• If you purchase a subscription, you must use a valid Apple ID or Google Play account and comply with that store’s terms.

Do not interact with the App in a way that distracts you while driving. Comply with all traffic laws and use mounting solutions and voice/hands-free features where appropriate. You assume all risk arising from use of the App while operating a vehicle. We are not liable for accidents, citations, or injuries related to distracted or unsafe use.

You agree not to:

• Submit fake, spoofed, or manipulated GPS data, or use tools intended to cheat distance, stats, or leaderboards.
• Harass, threaten, or abuse other users, or misuse friend/search features.
• Upload unlawful, infringing, or offensive profile/car photos or profile content.
• Reverse engineer, scrape, overload, or attempt unauthorized access to the API, accounts, or infrastructure.
• Abuse contact forms, support channels, or rate limits (including automated or deceptive submissions).
• Circumvent, share, resell, or misuse Premium entitlements, purchase receipts, or restore-purchase mechanisms.
• Use the App for any illegal purpose or in violation of export or sanctions rules.

We may suspend or terminate accounts that violate these Terms or harm the service or community.

5.1 DriveTrace Premium

DriveTrace Premium is an optional auto-renewable subscription offered through in-app purchases on the Apple App Store and Google Play Store. The subscription title, length (e.g. monthly or annual), price, and any free trial or introductory offer are shown in the App and/or the applicable store listing before you confirm purchase and may vary by plan, platform, and country/region.

5.2 Billing (Apple App Store)

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the renewal cost identified at purchase (or as later updated in accordance with these Terms and Apple’s rules).
• You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings after purchase (or via the subscription management screens Apple provides).
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that service, where applicable.

5.3 Billing (Google Play Store)

• Payment will be charged to your Google Play payment method at confirmation of purchase, subject to Google Play’s billing system and policies.
• Subscriptions renew automatically for the selected billing period unless you cancel according to Google Play’s cancellation rules before renewal.
• You can manage or cancel subscriptions in Google Play (for example via Google Play Subscriptions) and/or through in-app links we provide to that center.
• Unless required by law or Google Play policy, canceling typically stops future renewals while access continues through the end of the current paid period.

5.4 Payment processing & refunds

We do not collect or store your full payment card details. Purchases are processed by Apple or Google. Refunds, billing disputes, and chargebacks are handled under the applicable store’s policies (Apple App Store or Google Play), except where mandatory consumer law requires otherwise. 5.5 Price changes

We may change subscription prices. Where required (including under Google Play subscription policies), we will provide advance notice—typically at least 30 days before a price increase takes effect for an existing subscriber—and explain how to cancel. Continued use after the effective date of a notified change may constitute acceptance where permitted by law and store rules.

5.6 Entitlement & restoration

Premium access is tied to a valid store purchase and our verification of entitlement (e.g. receipt or purchase token validation). You can restore purchases on a device signed into the same Apple ID or Google Play account used to buy the subscription. We may revoke access if a purchase is refunded, charged back, expired, or found fraudulent.

In addition to these Terms, your download and use of the App from a store is subject to that store’s licensed application / end-user terms:

If there is a conflict between these Terms and the applicable store agreement regarding the store’s role as the seller of the App or in-app purchases, the store agreement controls for that conflict. Our Privacy Policy and these Terms continue to govern how we provide DriveTrace features and process your account data.

You retain ownership of content you submit (e.g. photos, usernames, drive data you generate). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content as needed to operate the App (including leaderboards and friend features).

You represent that you have the rights to submit that content and that it does not violate others’ rights.

The App, branding (including DriveTrace), software, and documentation are owned by us or our licensors. Except for the limited right to use the App as allowed by these Terms, no rights are granted to you. Premium does not transfer ownership of any software or content to you.

The App relies on third parties such as Firebase Authentication, Firestore, Storage, and Cloud Messaging; Apple and Google for distribution, authentication options, maps, and in-app purchase / billing; hosting providers; rate-limiting infrastructure; and reverse-geocoding providers. Their terms and privacy practices apply to their services. We are not responsible for third-party outages or changes beyond our reasonable control.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DRIVE DISTANCES, SPEEDS, ROUTES, LEADERBOARDS, COUNTRY INFERENCE, OR MAPS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE (GPS and device conditions vary). PREMIUM FEATURES MAY CHANGE OR BE INTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US (OR VIA THE APPLICABLE STORE FOR DRIVETRACE PREMIUM) IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the App, your content, or your violation of these Terms or applicable law.

You may stop using the App at any time and may delete your account in Settings or via our account deletion page. Canceling a Premium subscription (through Apple or Google Play) stops renewal but does not by itself delete your DriveTrace account. We may suspend or terminate access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive (including disclaimers, limitations, and indemnity) will survive termination.

These Terms are governed by the laws of the jurisdiction in which the operator of DriveTrace is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. Courts in that jurisdiction shall have exclusive venue, except where the law requires otherwise.

We may update these Terms by posting a revised version with a new effective date. Continued use after the effective date constitutes acceptance, except where additional consent is required.
